PUPPY SALES CONTRACT

SELLER warrants that this puppy is of typical temperament and structure and embodies the basic standards of the breed. This puppy has been examined and cleared of any defects. The puppy is in good health, free of any know contagious diseases and has had vaccination(s) required for its age at the time of this agreement. The purchase price of this puppy will be refunded if the Buyer furnishes the Seller with a veterinary certificate indicating that the puppy has a life threatening congenital defect or virus and returns the puppy to the Seller within 48 hours of delivery. Seller does not guarantee against communicable diseases beyond 48 hours of delivery. No veterinary or shipping cost will be reimbursed by Seller. Seller does not guarantee against avoidable disease caused by improper care or neglect by the Buyer. Vaccinations must be kept current or the guarantee is void regarding said puppy. Seller does not guarantee the appearance, size or weight of said puppy. Seller makes no guarantee regarding loss of the puppy because of accidental death, theft, sickness, etc. or any other loss beyond Seller’s control. Seller reserves the right to have a second veterinarian of her choice to evaluate the puppy’s condition before the warranty will be honored. Under no conditions and at no time during the life of the said puppy will Seller pay or assist in paying veterinary expenses after the puppy is purchased, including any such expenses directly or indirectly related to any inheritable/genetic defects.
BUYER agrees to have the puppy examined by a licensed veterinarian within 48 hours of receipt of the puppy. If the puppy is determined to be in poor health as evidenced by a veterinarian’s statement Buyer can elect to keep the puppy assuming all costs to its care, or may return the puppy for a full refund upon Seller’s receipt of the veterinarian’s statement regarding the puppy’s health. This provision will expire 48 hours after the Buyer takes possession of the puppy. Buyer certifies by signing this agreement the puppy is to be kept as a house pet only and reside only with the Buyer. Extensive time in outside areas, garage, or tied up outside is not allowed. The puppy is to be kept in the Buyer’s living quarters, will have adequate exercise, will be maintained in a good healthy condition, will be fed nutritious food, and necessary health care will be provided. The puppy will not be used as an attack dog or a guard dog for people, animals, or property. The Buyer shall provide the puppy with necessary veterinary care upon sickness, disease, or injury, and shall take it to a veterinarian at least once a year for an annual health examination and routine vaccinations. The Buyer shall provide the puppy with humane care and maintain it in accordance with all current and future state, county, and municipal laws and ordinances where the Buyer resides or will reside. If the puppy cannot be kept by the Buyer the Buyer shall notify the Seller immediately. This puppy may never be sold or given away to any individual, company, research facility, or group. Buyer understands that payment is due at the time Buyer takes possession of the dog. Balance of purchase price is to be paid in cash.
This sales contract is non-transferable. Should BUYER relinquish ownership in the puppy for any reason. The Sales Contract will be deemed null and void. Neither this Contract nor any provisions in it may be extended, amended, modified, altered, or changed, except in writing singed by Buyer(s) and Seller(s).
ADDITIONAL CLAUSES
Seller retains the right of first refusal, if at any time in the life of the puppy Buyer is unable or unwilling to keep the puppy. If Buyer desires to sell the puppy, Buyer agrees to contact Seller and allow Seller the first opportunity to purchase the puppy. If Seller exercises the right of first refusal and the puppy back with the intention of selling the puppy to another buyer. Seller agrees to pass whatever amount of money Seller receives for the sale of the puppy on to first Buyer, less any veterinary or other expenses that Seller incurs as a direct result of first Buyers ownership of the said puppy. Seller also retains the right of first refusal to take the puppy back should Buyer wish to place the puppy in a new home. Seller agrees to buy back said puppy after the puppy is examined by a licensed veterinarian and less any veterinary or other expenses that the Seller incurs as a direct result of the first Buyers ownership of the said puppy. The Buyer understands that the Seller has limited information and control regarding the future temperament, habits, and appearance of the said puppy, and hence does not warrant such. Any other transfer of this puppy without written permission of the Seller shall make the Buyer liable for any and all damages payable upon demand to the Seller.
GENERAL CONTRACT TERMS
All understandings between the parties are incorporated in this Contract. Its terms are intended by the parties as final and an exclusive expression of their agreement with respect to its subject matter, and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. If any provision of this Contract is held ineffective or invalid, the remaining provisions will nevertheless be given full force and effect. This Contract shall be governed by and construed in accordance with the internal laws of the State of Wisconsin and without reference to any rules of construction regarding the party responsible for drafting this Contract. The puppy shall reside at the address stated above by the Buyer. Any changes in the Buyer’s or Seller’s address or contact information must be relayed to the other party within 72 hours of the change. The singular form of Buyer and Seller includes the plural. In the event the laws of the state require any other provisions to be included in this Contract to make this Contract compliant with the laws of said state, then said provisions shall be deemed included herein. No action or failure to act by any party hereto shall constitute an approval of, or acquiescence in, any breach hereof except as may be specifically agreed in writing. If any consent or other approval is needed and is provided for in this this Contract, such consent or other approval shall not be unreasonably withheld, delayed, or conditioned.
